About these terms

These terms and conditions govern your use of the OLUME website at olumecreative.com and the services provided by OLUME. By using our website or engaging our services, you agree to these terms. If you do not agree, please do not use our website or services.

Using our website

You may use our website for lawful purposes only. You must not use it in any way that is unlawful, harmful, fraudulent or that infringes the rights of others. We reserve the right to restrict or remove access to our website at any time without notice.

All content on this website — including text, images, design, code and copy — is owned by or licensed to OLUME and protected by copyright. You may not reproduce, distribute or use any content from this website without our prior written permission.

Our services

OLUME provides brand identity, web design, social media management, content creation, email marketing and related creative services. The specific scope, deliverables, timeline and fees for any engagement are set out in the proposal and contract issued to each client. These terms and conditions apply alongside any such contract.

Proposals and contracts

A proposal issued by OLUME does not constitute a binding agreement. An engagement begins only when both parties have signed a contract and the agreed deposit has been received. All prices are quoted exclusive of VAT unless stated otherwise.

Payment terms

Payment terms are set out in each individual contract. Project fees are typically structured with a deposit at the start and staged payments aligned to project milestones. Retainer fees are invoiced monthly in advance. Invoices are issued via HoneyBook. Late payment may result in work being paused until outstanding amounts are cleared.

Intellectual property

All creative work produced by OLUME remains our intellectual property until full payment has been received. Upon receipt of final payment, ownership of the agreed deliverables transfers to the client as specified in the contract. We retain the right to display completed work in our portfolio and on our social media channels unless the client requests otherwise in writing.

Revisions and scope

Each deliverable includes the number of revision rounds specified in the contract. Requests that fall outside the agreed scope will be treated as new work and quoted separately. We will flag any scope change before proceeding.

Confidentiality

Both parties agree to keep confidential any information shared during an engagement that is not publicly available. This obligation continues after the engagement ends. We will not share client information with third parties except where required to deliver the agreed services (for example, with a developer or photographer working on your project).

Limitation of liability

OLUME is not liable for any indirect, consequential or incidental loss arising from the use of our services or website, including loss of revenue, profits or data. Our total liability to any client in connection with a project is limited to the fees paid by that client for the specific project in question.

Termination

Either party may terminate an engagement by giving written notice as specified in the contract. In the event of termination, the client is liable for fees covering all work completed up to the point of termination. Any deposit paid is non-refundable unless OLUME terminates the engagement without cause.

Governing law

These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

Changes to these terms

We may update these terms from time to time. The date at the top of this page reflects when they were last revised. Continued use of our website constitutes acceptance of any updated terms.
